Hosting terms and conditions

General Terms

Web hosting and design services are offered by Kingfisher Computer Services (KCS) to it's clients. Rates for our serivices will be agreed in advance of us providing the service.

By making a payment for our hosting or domain registration services, you are agreeing to the terms and conditions as stated below.

Domain name registration

  1. KCS will register and manage domain names on behalf of it's clients. KCS is not a domain registration agent, but uses selected partners to provide the registration service.
  2. To avoid registrar late payment fees, KCS will automatically renew your domain name up to 45 days before it is due to expire. If you do not wish your domain name to be renewed, you must inform us in writing at least 60 days before it's expiry date.
  3. Payment for domain names is subject to our usual terms and conditions of payment, with the following additions
    1. Late payments of invoices for domain name renewal will be subject to a charge equivalent to 50% of the domain registrars current late payment fee. (At 23rd November 2006 this would be equivalent to £117.50)
    2. KCS will not release for transfer any domains names that have an outstanding payment against them
    3. Where payments for domain names are overdue by more than 60 days, KCS will take ownership of the domain and may release it for sale.
  4. At your request KCS will release your domain name for transfer to another registrar or management agent. KCS will not be responsible for any related costs of transfer, nor will they carry out any transfer of the domain beyond it's release (.com domains) or reallocation to the new registrar (.uk domains).

Website hosting

  1. KCS web hosting is provided on an annual basis at the prevailing advertised rates, or other rate as agreed with you.
  2. KCS hosting must not be used for hosting sites in the following categories:
    1. content that is illegal, defamatory of, abusive or harmful to others
    2. content that infringes third party intellectual property rights
    3. software to distribute spam, viruses, or programmes that cause harm to computers and networks
  3. Due to the nature of the internet, we are unable to guarantee 100% availability of sites or services hosted with KCS

Cancellation and termination of hosting

  1. You must provide at least one months written notice to cancel your hosting account. Should you cancel your account before the end of your hosting period, no rebate of fees will be due from KCS
  2. In addition to our standard late payment terms, late payment of hosting accounts will lead to suspension of your account until outstanding debts are settled in full
  3. Cancellation of accounts may be made by KCS under the following circumstances:
    1. Where you have breached our hosting terms, KCS may cancel your account with no rebate of fees
    2. KCS may cancel hosting accounts by giving one months written notice. Where this is the case, a rebate equivalent to the unused portion of your annual hosting fee will be paid by KCS
  4. KCS do not provide or maintain account backups. On cancellation of your account, all account content will be deleted from our servers. Where our accounts include a backup facility this is for you to make your own local backups
